Constitution
Title
The association of parents and teachers of Jockey Club Man Kwan EduYoung College shall be known as the “Jockey Club Man Kwan EduYoung College Parent-teacher Association” (the “Association”).
Address
The address of the Association shall be 5, Tin Wing Road, Tin Shui Wai, Yuen Long, N.T. (Jockey Club Man Kwan EduYoung College).
Aims
The aims of the Association shall be:
3.1) strengthening communication between families and the School, and between parents and teachers;
3.2) exchanging views in matters of mutual concern and fostering a concerted effort in improving the welfare of students; and
3.3) supporting the school and advancing education.
4. Membership
4.1) Qualifications:
a. all parents of students attending the school (shall automatically become members);
b. present Principal and teachers of the School; and
c. any parents of former students, former Principals and former teachers of the School who have substantially contributed to the well-being of the Association, or any prominent members of the community, persons who care about the affairs of the Association and have substantially contributed to the Association, may be invited by the Executive Committee to be an Honorary Member for such term as the Executive Committee shall determine.
4.2) Rights and Obligations
a. Each member shall have the right to elect or be elected as the members of the Executive Committee, and the right to vote at the General Meetings they attend;
b. Each member shall have the obligations to observe the articles of this Constitution, to abide by the decisions of the General Meetings and to pay the Annual Subscription Fee;
c. Members shall pay a HK$30.00 Annual Subscription Fee within two weeks after being accepted as a member of the Association, and shall pay the Annual Subscription Fee in September of each year afterwards (when the new school year begins);
d. Except for the fees stated in (c), members shall have no obligation to provide additional financial assistance to the Association. However, any member may donate to the Association as per their wish for contributing.
e. All Annual Subscription Fees once paid shall not be refunded; and
f. Honorary members shall have no right to elect or be elected as the members of the Executive Committee and no voting rights but may attend the General Meetings. They shall enjoy all welfare and benefits as are given to other members and shall pay a HK$30.00 Annual Subscription Fee in September of each year.
5. Organization
5.1) The organization of the Association shall consist of a General Assembly and an Executive Committee.
5.2) The General Assembly shall be composed of all members and be the highest authority of the Association. When the General Assembly is in recess, all matters of the Association shall be conducted by the Executive Committee.
5.3) General Meetings of All Members shall be convened by the Executive Committee and Annual General Meetings of All Members or Extraordinary General Meeting(s) of All Members may be convened by the Committee.
5.4) The General Meetings shall be held once every two years for the purpose of electing members of the Executive Committee for the two years. The Committee shall also meet for reporting the affairs and the financial position of the Association annually and shall announce to all members in the form of parent letters should there be no General Meeting for the year.
5.5) Extraordinary General Meeting(s) may be convened by the Executive Committee after the receipt of a requisition in writing signed by at least 7 members of the Association for discussing any special matter(s). The Extraordinary General Meeting(s) shall be called by 14 days’ notice to every member.
5.6) The quorum of all General Meeting(s) shall be 40 members.
5.7) The Executive Committee shall consist of 12 members including 6 Parent Members and 6 Teacher Members.
5.8) Appointment of Parent Members of the Executive Committee:
Parent Members shall be nominated and invited by the outgoing Parent Members of the Executive Committee for an election and 6 Parent Members shall be elected at the Annual General Meeting.
5.9) Appointment of Teacher Members of the Executive Committee:
Teacher Members shall be appointed by teaching staff before the Annual General Meeting and the result shall be confirmed at the Meeting.
5.10) The new and previous Executive Committee shall meet as soon as possible after the Annual General Meeting for electing the Members of the following:
a. Chairperson (one Parent Committee Member only)
b. Vice-Chairpersons (one Parent Committee Member and one Teacher Committee Member)
c. Secretaries (one Parent Committee Member and one Teacher Committee Member)
d. Treasurer (one Teacher Committee Member only)
e. Activities Officers (one Parent Committee Member and one Teacher Committee Member)
f. Promotion Officers (one Parent Committee Member and one Teacher Committee Member)
g. Publication Officers (one Parent Committee Member and one Teacher Committee Member)
5.11) If a Parent Committee Member’s child(ren) leaves the School during his/her term of office as a Committee Member, his/her term of office shall continue until its expiry or to the end of the school year, whichever is the earlier.
5.12) Except for the Teacher Committee Members, the term of office of every member shall be two years and Parent Committee Members may offer themselves for re-election.
5.13) The Executive Committee shall have the power to co-opt members as co-opted members to fill vacancies occurring its term.
5.14) The Executive Committee shall have the power to co-opt members to serve as advisors for any particular purpose(s).
5.15) Within the same term of office, each family shall not have more than one member to serve as the Committee Member of the Executive Committee.
5.16) In the case of an equality of votes at any meeting mentioned above, the Chairperson shall have a second or casting vote.
5.17) All work undertaken by members for and on behalf of the Executive Committee is on a wholly voluntary basis.
6. Parent Manager and Alternate Parent Manager
After the Incorporated Management Committee of Jockey Club Man Kwan EduYoung College (IMC) was established as an Incorporated Management School and the Association received the letter by the IMC recognizing the Association as an accredited Parent-teacher Association, the parents nominated have been registered as Parent Manager and Alternate Parent Manager in accordance with the number specified in the constitutions of the IMC. The nominating persons for registration as Parent Manager and Alternate Parent Manager shall be elected by the Association in accordance with the provisions of Article 7 of the Constitution of the Association.
7. Election of Parent Manager and Alternate Parent Manager
1) The Association will appoint a Returning Officer for supervising the election process and ensuring the election to be conducted under the principle of fairness, equity and openness.
2) Parent Members shall be distributed the first election notice and a nomination form before the election. Any member who has an intention to nominate himself/herself or another member to stand for the election shall submit the nomination form 14 days before the election.
3) All parents of a current student are eligible to nominate or/and to be nominated as a Parent Manager.
4) A candidate for the Parent Manager election may be nominated by self-nomination or eligible nominee(s).
5) 7 days before the election, Parent Members shall be distributed the second election notice, introduction of the candidates and the ballot papers.
6) On the election day, Parent Members may vote in person or have their child submit the ballot paper on behalf of them at the time specified.
7) Once the poll is closed, a public vote-counting will be carried out on the same day, Parent Members may attend as per their wish.
8)The candidate who obtains the greatest number of votes shall be nominated and registered as Parent Manager of the IMC.
9)The candidate who obtains the second greatest number of votes shall be nominated and registered as Alternate Parent Manager of the IMC.
10)If the voting results in an equality of votes, the result shall be determined by drawing lots conducted by the Returning Officer.
11) The result of the elected Parent Manager and Alternate Parent Manager will be announced on the day following the close of the election day. If any Parent Member has any doubts about the election result, he/she may appeal in writing within 7 days.
12) After the 7-day appeal period of election result, the Parent Manager and Alternate Parent Manager will register in writing with the Education Bureau (EDB) within two weeks.
13) The term of office of the Parent Manager and Alternate Parent Manager is subject to the Constitution of the IMC.
14) If the child(ren) of the Parent Manager and Alternate Parent Manager has ceased to be a current student of the School during the term of office as the Parent Manager or Alternate Parent Manager, his/her term of office shall continue until its expiry or to the end of the school year, whichever is the earlier.
15) If the Parent Manager and Alternate Parent Manager leaves office during the term, another Parent Manager and Alternate Parent Manager election procedure will be scheduled within three months.
8. Finance
8.1) The Association may use the funds of the Association for developing association affairs and making payment of expenditure of the Association.
8.2) The Treasurer shall report the financial status of the Association at the General Meeting of the Executive Committee.
8.3) The Executive Committee shall have the power to grant at its discretion certain amounts of money from the Association Funds to the School to be used for scholarships, prizes or other purposes and the Principal, with the consent of the Committee, shall have full authority to use the funds so granted.
8.4) The Executive Committee shall be responsible to deposit all the receivables in an appointed bank. All cheques for withdrawal of the Association Funds shall be valid only if signed by the following persons: the Chairperson and the Treasurer, and the two persons who signed shall be one Parent Member and one Teacher Member.
8.5) The Executive Committee shall be liable for any debts and/or liabilities incurred by the Association.
9. Honorary Auditor
The General Assembly shall appoint an Honorary Auditor who shall audit at least once a year the accounts of the Association.
10. Amendments to the Constitution
10.1) Any amendment to the Constitution shall be approved by a two-thirds majority of the Members present at the meeting.
10.2) Amendment of the Constitution may be proposed by the Executive Association basing on the actual need.
10.3) Any motion to amend the Constitution shall be passed by the General Assembly before the resolutions are validly passed.
11. Dissolution of the Parent-teacher Association
1) The Association shall be dissolved if two-thirds of the Members present at the Annual General Meeting or the Extraordinary General Meeting are in favour of such dissolution.
2) Any property of the Association left over upon dissolution of the Association shall be donated to the School or local charities upon the decision of every member.
